Welcome to Elevare Wellness Network. These Terms of Service (“Terms”) govern your access to and use of our website (elevarewellnessnetwork.com), the My Health Coach Now (MHC-Now) platform, and any associated wellness services, benefits, or programs (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. THE ELEVARE WELLNESS NETWORK MODEL

Elevare Wellness Network is a membership-based association dedicated to physical, mental, and financial wellness. You acknowledge that:

Facilitation Only: Elevare provides a platform and a network of third-party benefits and independent wellness professionals.
No Medical Advice: The information provided via the MHC-Now app, health education modules, or "Tip of the Day" messages is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
Association Benefits: Certain benefits (e.g., RX discounts, insurance products) are provided by third-party carriers. Your eligibility for these is subject to the specific terms and underwriting of those carriers.

2. ELIGIBILITY AND ACCOUNTS

Age Requirement: You must be at least 18 years of age to create an account.
Account Security: You are responsible for maintaining the confidentiality of your login credentials for the MHC-Now portal and are liable for all activities under your account.
Accurate Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.

3. MEMBERSHIP AND FEES

Association Fees: Membership in the Elevare Wellness Network may require a monthly association fee.
Billing: Fees are billed as a separate line item. If you are part of an employer-sponsored group, billing may be handled through aggregate employer billing or individual billing as specified in your enrollment package.
Incentives & Points: The Healthy Rewards Challenge and other point-based incentives are subject to active membership status. Points have no cash value and are non-transferable.

4. USE OF TECHNOLOGY (MHC-Now & Wearables)

Device Integration: Our platform supports integration with over 60 smart apps and wearable devices (e.g., Fitbit, Apple Health). You are responsible for the data accuracy and connectivity of your personal devices.
Proprietary Rights: All software, code, and content within the MHC-Now platform and the Elevare website are the proprietary property of Elevare Wellness Network or its licensors.

5. PROHIBITED CONDUCT

You agree not to:

Use the Services for any unlawful purpose.
Attempt to "scrape" data or use automated bots to access member information.
Impersonate any person or entity, including Elevare staff or network trainers.
Distribute viruses or any other technologies that may harm the Network or the interests of its members.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Elevare Wellness Network, its officers, and its partners shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Services. This includes, but is not limited to, physical injury during exercise or financial decisions made based on wellness education materials.

7. TERMINATION

We reserve the right to suspend or terminate your membership and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other members of the Network.

8. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of [Insert Your State, e.g., Florida/Delaware], without regard to its conflict of law provisions.
